General Terms and Conditions of Sale

Scope of application

1.1. The internet site noline4us.com (hereinafter the “Site”) enables the online purchase of a selection of products from the brand PHOENIX INNOVATIONS, SASU with a share capital of 1000 Euros registered with the RCS 844 453 431, the head office is located at 672 RUE DES MERCIERES 69140 – RILLIEUX LA PAPE represented by its President, Antonio TURRI.

The Site is managed by PHOENIX INNOVATIONS.

 1.2. These general terms and conditions of sale (“GTC”) govern all relations between PHOENIX INNOVATIONS and the customer (hereinafter the “Customer”), domiciled in metropolitan France and aged 18 or over. The purchase of Products for resale is prohibited. Minors under 18 years of age may not purchase Products on the Site without the permission of a parent or guardian.

 The GTC apply to all orders placed by the Customer, to the exclusion of all other conditions.

The Customer acknowledges that he/she has read the GTC and has accepted them unreservedly in their entirety by validating his/her order and by ticking the box: “I accept the General Terms and Conditions of Sale and the Policy on the use of personal data”.  In accordance with the law of 6/01/1978, you have the right to access, rectify and object to information concerning you that you can exercise at any time at the following address

The applicable GTC are those in force on the day of the order.

 Right of withdrawal

The Customer has the right to withdraw from the purchase of the above-mentioned Products without giving any reason within a period of fourteen (14) days. The withdrawal period expires fourteen (14) days after the day on which the Customer, or a third party other than the carrier, designated by the Customer, takes physical possession of the said Products.

In order to exercise the right of withdrawal, the Customer must notify PHOENIX INNOVATIONS of his decision to withdraw by means of an unambiguous statement by letter sent by post to the address: 672 RUE DES MERCIERES 69140 – RILLIEUX LA PAPE or by e-mail: contact@noline4us.com.

In order for the withdrawal period to be respected, it is sufficient for the Customer to transmit his communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.

Effects of withdrawal

In the event of withdrawal, PHOENIX INNOVATIONS will reimburse the Customer for all payments received from the Customer, including delivery costs (with the exception of additional costs arising from the fact that the Customer has chosen a delivery method other than the cheaper standard delivery method provided for in the GTC), without undue delay and in any event no later than fourteen (14) days from the day on which PHOENIX INNOVATIONS was informed of the Customer’s decision to withdraw.

PHOENIX INNOVATIONS may postpone the reimbursement until it has received the Product(s) in question or until the Customer has provided proof of shipment of the said Product(s), the date used being that of the first of these facts.

The Customer must return the Product(s) concerned to the following address: 672 RUE DES MERCIERES 69140 – RILLIEUX LA PAPE , without undue delay and, in any event, no later than fourteen (14) days after the Customer has communicated his/her decision to withdraw. This period is deemed to have been respected if the Customer returns the Product(s) before the expiry of the fourteen (14) day period.

The Customer shall bear the direct costs of returning the Product(s) concerned.

Changing the order

The Customer cannot cancel or modify his order after the confirmation of the order presented on the Site, with the exception of the limited cases provided below. Nevertheless, the Customer Service Department is available to help the Customer find the best solution.

The Customer may request to change the delivery address, provided that this request is made on the day the order is confirmed. If the order is placed on a Saturday, Sunday or public holiday, the request to change the delivery address is possible on the next working day. No change in the delivery address is possible if the above conditions are not met.

Availability of Products

The Products are sold within the limits of available stocks. In the event of the Products becoming unavailable after the order has been placed, the Customer will be informed as soon as possible by e-mail. PHOENIX INNOVATIONS will then reimburse the costs paid by the Customer for the unavailable Products.

Archiving the order

Each order is archived by PHOENIX INNOVATIONS for a period of 10 years from the last delivery. At any time, the Customer can access the details of his past orders by sending an e-mail to Customer Services at the following address: contact@noline4us.com

 Prices

The prices that appear on the Site are prices in euros, including the costs of processing the order and are inclusive of all taxes, including VAT and the duties and taxes in force at the date of the order. Any change in the rate of these taxes will be reflected in the price of the Products.

The shipping costs of the Products are provided according to the shipping method and the quantities shipped.

Before validating the order, the Customer is informed of the transport price and the total price to be paid (including VAT, taxes and transport costs).

PHOENIX INNOVATIONS has the right to modify its prices at any time. However, the price shown on the Site on the day the order is validated will be the only one applicable.

 Payement

The price is due and collected in full upon validation of the order. Payments are made online by credit card (Carte Bleue, Visa, Mastercard) or by PayPal. The amount of the price is debited as soon as the order is validated (after entering the bank details).

In the event that the payment of the price is incomplete or non-existent, for a reason attributable to the Customer, the order shall be automatically cancelled and any costs arising therefrom shall be borne by the latter, without prejudice to any damages.

Promotional codes

Promo codes are only valid for the duration and according to the conditions of validity that they expressly mention. They cannot be converted into a sum that is refundable or payable to the Customer.

Unless otherwise stated on the promo codes, they cannot be combined with each other when placing an order.

Shipping

The Products are delivered to the shipping address indicated by the Customer when placing the order. The shipping address may be different from the billing address.

Delivery time

The maximum delivery time as from the validation of the order is ten (10) working days. It depends on the shipping method.

In the event of a significant delay in delivery, the Customer will be informed as soon as possible or by e-mail and will be offered an alternative solution.

The Customer undertakes to check the Products upon receipt and to mention any reservations on the delivery note, particularly in the event of damage to the package or non-conformity with the order. He/she shall notify PHOENIX INNOVATIONS of any reservations he/she has about the Products delivered within a maximum of three (3) days following the date of receipt of the Products. After this date, no claim is admissible and the products are deemed to be in conformity.

Return and exchanges

PHOENIX INNOVATIONS undertakes to reimburse the Customer in the event that the Products are stolen and visibly damaged before being unpacked or do not conform to the order under the following conditions:

  • In the event of theft, the Customer has sent Customer Services a copy of the theft complaint filed with the competent authorities or a sworn statement that the package was not received,
  • In the event of damage to the Products, the Customer has sent Customer Services a photograph of the package with the delivery label visible and legible and of the Products damaged during transport,
  • In case of non-conformity with the order.

Responsibility

PHOENIX INNOVATIONS cannot be held responsible if the non-performance or delay in the performance of an obligation is the result of a case of force majeure (in particular in the event of natural disasters, fires, internal or external strikes, internal or external failures or breakdowns) or of an unforeseeable and insurmountable act by a third party.

The Products are packaged in optimal condition in order to limit the risk of breakage. The Customer must unpack the Products with care, prudence and attention to detail. PHOENIX INNOVATIONS cannot be held responsible for breakage resulting from the opening of the packaging.

Questions and claims

For any question or information on the status of the order, for any complaint (damage, theft or non-conformity of the Products to the order), the Customer Service is at the disposal of the Customer either by telephone at +33 (0) 487 375 153 (price of a local call from a fixed line), this service is open from Monday to Friday from 9 am to 6 pm (closed on Saturdays, Sundays and public holidays), or by e-mail at the following address contact@noline4us.com or by post to the following address: 672 RUE DES MERCIERES 69140 – RILLIEUX LA PAPE .

Duration

The Products are offered for sale on the website shop.noline4us.com, subject to availability. Orders placed are honoured in accordance with these GTC and within the limits of available stocks.
